1000 Dollar Legal Defense Program Terms of Service

Definitions and Interpretation
1.1. In this agreement:
(a) "Terms" refers to these Terms of Service;
(b) "Site" refers to the website located at owned and operated by 1000 Dollar Legal Defense Program;
(c) "Program" refers to the 1000 Dollar Legal Defense Program;
(d) "We," "us," or "our" refers to 1000 Dollar Legal Defense Program;
(e) "Affiliate Attorney" refers to the attorney or law firm that has been accepted into the Program;
(f) "Client" refers to a client who has been referred to the Affiliate Attorney by the Program.


Acceptance of Terms
2.1. These Terms govern your access to and use of the Site, and by accessing or using the Site, you agree to be bound by these Terms, including the new terms applicable to Affiliate Attorneys. If you do not agree to these Terms, you must not access or use the Site.


3.1. By accessing or using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.


4.1. Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, store, and disclose your personal information when you access or use the Site.


Intellectual Property Rights
5.1. All content, trademarks, logos, and other intellectual property displayed on or available through the Site are the property of their respective owners and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Site without our express written permission or the permission of the applicable rights holder.


Affiliate Attorneys
6.1. The Program provides the opportunity for attorneys to become Affiliate Attorneys.
6.2. Acceptance into the Program is at our sole discretion, and we reserve the right to reject any application.
6.3. By applying to become an Affiliate Attorney, you agree to be bound by these Terms and the terms specific to Affiliate Attorneys set out in Section 7.


Terms Specific to Affiliate Attorneys
7.1. The following terms apply to Affiliate Attorneys:
(a) The Program will only accept one Affiliate Attorney per county;
(b) The Affiliate Attorney must pay a monthly fee to the Program based on the size of the county they are operating in;
(c) The Program will refer Clients to the Affiliate Attorney;
(d) The Affiliate Attorney must charge $1,000 or less per misdemeanor case for Clients referred by the Program;
(e) The Affiliate Attorney may set their own rates for felony cases referred by the Program;
(f) The Affiliate Attorney must conduct themselves in a professional manner at all times;
(g) The Affiliate Attorney must comply with all applicable laws and regulations;
(h) The Affiliate Attorney must not engage in any unethical behavior;
(i) The Program may terminate this agreement and the Affiliate Attorney's participation in the Program at any time, and the Affiliate Attorney may terminate this agreement and their participation in the Program by providing written notice to the Program;
(j) The Affiliate Attorney must keep all Client information confidential and must not disclose it to any third party without the Client's consent;
(k) The Affiliate Attorney must comply with all applicable privacy laws and regulations;
(l) The Program owns all intellectual property associated with the Program, including but not limited 

to the Program's name, logo, and website, and the Affiliate Attorney must not use the Program's intellectual property without prior written permission from the Program;
(m) The Program is not liable for any damages, losses, or expenses incurred by the Affiliate Attorney in connection with their participation in the Program, and the Affiliate Attorney is solely responsible for their own actions and any legal or financial liability resulting from their participation in the Program.


User Conduct
8.1. By accessing or using the Site, you agree not to:
(a) Violate any applicable laws or regulations;
(b) Use the Site for any illegal or unauthorized purpose;
(c) Interfere with or disrupt the operation of the Site, its servers, or networks;
(d) Attempt to gain unauthorized access to the Site or any user accounts;
(e) Submit or post any content that is offensive, defamatory, obscene, or otherwise inappropriate;
(f) Infringe upon the intellectual property rights of others;
(g) Engage in any activity that could damage, overburden, or impair the Site or our systems.


9.1. The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2. We do not warrant that the Site will be error-free, uninterrupted, secure, or free from viruses or other harmful components. Your use of the Site is at your own risk.


Limitation of Liability
10.1. In no event shall we, our affiliates, or our respective officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your access to or use of the Site or any content thereon, even if we have been advised of the possibility of such damages.


11.1. You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.


Governing Law and Jurisdiction
12.1. These Terms and any disputes arising from or relating to your access to or use of the Site shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Texas for the resolution of any legal matter arising from these Terms.


Changes to These Terms
13.1. We reserve the right to modify or update these Terms at any time, in our sole discretion. Any changes will be effective when we post the revised Terms on our Site. Your continued access or use of the Site following the posting of changes constitutes your acceptance of those changes.


14.1. We may terminate or suspend your access to or use of the Site, without prior notice or liability, for any reason or no reason, including, but not limited to, your breach of these Terms. Upon termination, your right to access or use the Site will immediately cease.


15.1. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum 

extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.2. These Terms, including the terms specific to Affiliate Attorneys set out in Section 7, constitute the entire agreement between you and us regarding your use of the Site and the Program, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
15.3. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. We may freely assign or transfer these Terms without restriction.
15.4. The headings in these Terms are for convenience only and do not affect the interpretation of these Terms.
15.5. We may provide you with notices, including those regarding changes to these Terms, by email, regular mail, or postings on the Site.
